LEBANON TOWN BOARD MEETING LEBANON TOWN OFFICES THURSDAY, March 4, 2010 7:35 p.m. to 11:47 p.m. MINUTES Members Present: Chair Lohny Fredrick, Supervisors Todd Wilson and LeRoy Tietz, Clerk Deborah Behl, Treasurer Jon Schoenike. Pledge: The Pledge of Allegiance was recited. Public Notice: Clerk reported that agendas were posted on March 1, 2010 and revised agendas were posted in the morning of March 4, 2010. Public Input: None at this time. Preview Agenda: Fredrick added two agenda items under #20 Board Member Reports. (1) Wilbur Schneider assessment question (2) Kevin Zubke land question. Agenda approved by consensus. Minutes: MOTION: (Wilson, Tietz) to approve the February 2010 Board minutes as distributed. Carried on voice vote. Treasurer’s Report: MOTION: (Tietz, Fredrick) to approve the Treasurer’s Report. Carried on voice vote. Sanitary District #2: MOTION: (Fredrick, Wilson) to appoint Michael Pease to the position of Lebanon Sanitary District #2 Commissioner. Carried on voice vote. Clerk Behl administered the Oath of Office to Mr. Pease. Dan Wildish, Sanitary District #2 Commissioner, reported that District #2 will be taking over the Hidden Meadows water system. They will lease the land and own the buildings. Attorneys are presently working on permanent easements. High arsenic levels in the water system are being remedied. Operator Licenses: MOTION: (Frederick, Tietz) to approve Operator’s Licenses for Jessica J. Streich and Wesley F. Braunschweig for the period ending June 30, 2010 pending clear background checks. Carried on voice vote. Temporary Class “B” Picnic License: MOTION: (Fredrick, Wilson) to approve a Temporary Class “B” Picnic License for Lebanon Sportsmen’s Club for March 21, 2010 Consignment Sale. Carried on voice vote. Land Use Issues (a.) Sport Haus: Phil Eppler, owner, was present to answer questions on their proposed addition. Discussion about Fire Department’s cistern on the Eppler property. Phil was directed to check his deed for any mention of the cistern. Chair stated this matter should be cleared up before improvements are made to the cistern area. MOTION: (Fredrick, Wilson) to send a favorable recommendation to Dodge County to grant a conditional use permit for the proposed addition to Lebanon Sport Haus at N1749 County Road R. Carried on voice vote; no negative votes. MOTION: (Fredrick, Wilson) to approve the Land Lease Agreement by Town of Lebanon and HudsonTowers LLC of Deerfield Beach, Florida for 7500 square feet of land at N2025 County Road R. Carried on voice vote; no negative votes. Lease attached. Land Use Issues (b.) Cell Phone Tower at Lebanon Firemen’s Park: MOTION: (Wilson, Tietz) to send a favorable recommendation to Dodge County to grant a conditional use permit for the proposed cell phone tower at N2025 County Road R. Carried on voice vote; no negative votes. Land Use Issues (c.) Muche CSM: MOTION: (Fredrick, Wilson) to approve the CSM for W4189 Davidson Road, Marvin Muche owner, Kevin Muche agent. Carried on voice vote; no negative votes. Convene into Closed Session: MOTION: (Fredrick, Wilson) to convene into closed session for considering employee evaluation and compensation pursuant to Wisconsin Statutes 19.85(1)(c)&(f) for our full-time employees. Carried on roll call vote. Wilson – Yes, Tietz – Yes, Fredrick – Yes. Board went into closed session. Reconvene into Open Session: MOTION: (Fredrick, Tietz) to reconvene into open session. Carried on roll call vote. Wilson – Yes, Tietz – Yes, Fredrick – Yes. Board reconvened in open session. Resolution L-10-D Employee Compensation: Table to April meeting. Police Report: Officer Beal presented monthly police report which is on file. - New squad car was put into service and is available for viewing. Fire Department Report: Fire Chief Brent Boyd reported: - Plans for cistern project in alley by Ivy Street. Depending upon what Eppler finds in his deed, we will have our attorney execute a lease for the cistern property. - An invitation was received from the Maibach Germany Fire Department to attend the dedication of their new fire station. A gift has been sent. Highway Superintendent: Brent Boyd, Highway Superintendent reported: - Still no decision received to date on CDBG for Monroe Road Project. - Waiting for prevailing wage determination from State for Poplar Grove project. - Annual Road inspections will be on April 21 at 3:00 pm. - Bids for roadwork will be opened on April 21 at 7:00 pm. - Consensus to sell cement berm from collection site area to Jay Smith upon receipt of reasonable offer. - Discussion on road rating system. LEBANON TOWN BOARD MEETING LEBANON TOWN OFFICES THURSDAY, March 4, 2010 7:35 to 11:47 p.m. MINUTES page #3 Park Committee: Leroy Tietz of the Park Committee reported: - Lebanon Lions Easter Egg Hunt will be at the Firemen’s Park on April 3rd. - Player (user) Fees for 2010 will remain at $10.00 per person. Baseball players will also pay the player fees. Player fees will be collected earlier in the year. - Question raised on who will collect the donations at the baseball games and who will be responsible for depositing the money. Board Member Reports: - Wilson reported that a resident wants to donate their library to the Town. Consensus that Town has no use or place for the library at this time. - Wilson voiced displeasure over our Attorney Plier and requested a review of his contract be put on the April agenda. - Clerk questioned procedure for issuing a 6 month Class “B” license to the Fire Department. Put on next agenda. - Fredrick reported on question he received from Kevin Zubke regarding a sale of property to adjoining property owner. - Fredrick reported on assessment questions he received from Wilbur Schneider. - Schoenike reported that the annual rabies clinic will be on March 27. Upgrading Town Website: Tabled. Operator License Application Form: A revised form will be prepared for the next meeting. Review of Town Fees Charged: Tabled. Set Future Meeting Dates: - April 1 7:30 pm Town Board Meeting - April 13 8:00 pm Annual Town Meeting - April 21 3:00 pm Road Inspection, Road Bid Opening, Board Meeting - May 6 12:00-2:00 pm Open Book. - May 27 6:00-8:00 pm Board of Review Future Agenda Items: - Fredrick stated joint meeting with the Planning Committee scheduled for March 23 will be postponed to a later date. - Appoint alternate Board of Review Members. Monthly Bills: Bills for the month were reviewed. MOTION (Wilson, Tietz) to pay bills in the amount of $34,990.36. Carried by voice vote. Adjournment: MOTION (Wilson, Tietz) to adjourn. Carried.
