JUNE BOARD MINUTES
1. Lebanon Town Board met on Thursday, June 4, 2009, for the Monthly
Board Meeting, at 7:00 o’clock P.M. at the Town Offices, Lebanon.
Present were the Chairman, Lohny Fredrick, who called the meeting to
order, the Supervisors, Todd Wilson and LeRoy Tietz, Clerk Dorothy
Kuehl and Treasurer Jon Schoenike.
2. Pledge of Allegiance was led by the Chairman.
3. The Clerk verified the posting of the agenda on Saturday May 30,
2009, at the Lebanon Town Offices, Lebanon Post Office, and Recycling
Center. The Universal Co-op was first posted on Monday June 1st, and
then an amended agenda was posted at all places on Monday, the 1st of
June. Also faxed to the Daily Times.
4. The Chairman previewed the agenda and a dog complaint was discussed
as the Police Officer will not be present tonight. No public input.
5. The licenses that were filled out were reviewed, Paul Michael
DeAngelis, Jr., Phil D. Eppler and Rachel R. Smith. A Public Hearing
will be held at 6:00 p.m. on Wednesday, June 17, 2009. An additional
meeting will be held on Wednesday, June 24, 2009 at 7:00 p.m. to grant
the new licenses and other business as may come up.
6. MOTION WAS MADE BY WILSON AND SECOND BY TIETZ TO APPROVE THE
MINUTES FOR MAY MEETING AS MAILED. M. C.
7. The Treasurer read the Treasurer’s report. MOTION WAS MADE BY
TIETZ AND SECOND BY FREDRICK TO ACCEPT THE TREASURER’S REPORT AS READ.
M. C. Jon will have an issue to bring up under Board member
reports.
8. No Police report received.
9. The Land Division Officer, Dave Gettelman was not present and had
nothing to report.
10. A repeal Ordinance L-09-E was explained. A MOTION WAS MADE BY
TIETZ AND SECOND BY FREDRICK TO ADOPT ORDINANCE L-09-E, REPEALING
L-98-1, RELATING TO NUDITY IN PUBLIC PLACES PREVIOULY ADOPTED ON APRIL
15, 1998. M. C.
11. A repeal Ordinance L-09-F was explained. A MOTION WAS MADE BY
FREDRICK AND SECOND BY WILSON TO ADOPT ORDINANCE L-09-F, REPEALING
L-04-1, BANNING NUDE DANCING IN BARS AND TAVERNS PREVIOUSLY ADOPTED
MAY 6, 2004. M. C.
12. Highway Superintendent Brent Boyd gave his report. Brent stated
that he opened Monroe Road. Guardian has done all road crossings.
Payne & Dolan did the shouldering. The safety grant received, we are
not eligible. Nothing was heard on the salt bid with the State. A
radio grant at the shop was put in for and he applied for a grant for
a stand by generator. David Lauersdorf was present and asked
questions about Monroe Road culverts and the railroad crossing on CTH
R. Fredrick asked about the weeds on lot 4 at Summer Hill Ct. and
Fredrick will talk to the owner. The Town of Emmet Fire Contract is
ready. MOTION BY FREDRICK AND SECOND BY TIETZ TO APPROVE THE 2 YAER
AMENDED CONTRACT FOR THE TOWN OF EMMET. M. C.
14. Park Committee report was explained by Brent. Board discussed
the rental of ball field to leave at $100.00 and they discussed the
shelter project.

16. Under Board member reports, Jon explained the checks mix up at
the Bank, which did not come back last year, which the Town had one.
15. The Board reviewed the bills for June. MOTION WAS MADE BY
FREDRICK AND SECOND BY WILSON TO APPROVE THE BILLS AS PRESENTED. M.

17. MOTION WAS MADE BY WILSON AND SECOND BY TIETZ TO ADJOURN THE
MEETING AT 10:25 P.M. M. C.
Dorothy Kuehl, Clerk.
1. The Town Board also met on Wednesday, June 17, 2009 at 6:00 p.m.
for a Public Hearing on Liquor Licenses. Chairman Lohny Fredrick
called the meeting to order. Supervisors, Todd Wilson and LeRoy Tietz
and Clerk Dorothy Kuehl were also present.
2. Chairman led the Pledge of Allegiance.
3. The Clerk verified the posting of the agenda on Saturday June
13th at all places and reposting on Monday, June 15th an amended
agenda.
4. Chairman explained how the hearing will work and opened the
hearing at 6:10 p.m.
67 people signed the register and the following spoke all in
opposition to granting the
Roadhouse liquor license. Charles Werth read his statement

5. Chairman, Fredrick declared the hearing closed at 7:18 p.m.

1. The Town Board also met on Wednesday, June 24, 2009 at 4:45 p.m.
Chairman Fredrick called the meeting to order, Present were Fredrick,
and Supervisor Tietz and Clerk Dorothy Kuehl, Attorney, Doug Plier and
Officers Dave Beal and Steve Allerman, also Supervisor Todd Wilson by
Speaker Phone from Alaska at 5:00 p.m. MOTION WAS MADE BY FREDRICK
AND SECOND BY TIETZ TO ADJOURN INTO CLOSED SESSION TO CONFER WITH
LEGAL COUNSEL FOR THE TOWN. M. C. MOTION BY FREDRICK AND SECOND BY
TIETZ TO ADJOURN FROM CLOSED SESSION TO MEETING AT 7:30 P.M. M.

2. Called to order by Chairman Fredrick at 7:30 p.m. Present were
Fredrick and Supervisor Tietz and Clerk Kuehl.

4. Clerk verified that the agenda was first posted on Saturday, June
13th then amended on Monday, June 15th and also amended on Tuesday
June 23rd , at all places regularly posted and faxed to the Times.
5. Fredrick previewed the agenda, Tietz announced that recycling
center would be open on Friday, July 3, from 1:00 p.m. to 5:00 p.m.
instead of July 4th. No other public input.
6. MOTION BY TIETZ AND SECOND BY FREDRICK TO DISPENSE WITH THE MINUTES
AND TREASURERS REPORT. M. C.
7. The CSM for David Wille was discussed. MOTION BY FREDRICK AND
SECOND BY TIETZ TO APPROVE THE CSM FOR DAVID WILLE. M. C. Then the
CSM for Paul and Therese Pankow was reviewed. MOTION WAS MADE BY
TIETZ AND SECOND BY FREDRICK TO ACCEPT THE CSM FOR PAUL & THERESE
PANKOW. M. C. The CSM’s were then signed by Chairman and Clerk.

TO APPROVE THE CIGARETTE LICENSE FOR SPORT HAUS, ROADHOUSE, R-STATION
AND UNIVERSAL COOP. M. C.
Under Board member reports Fredrick signed the weed notices. Tietz
again stated that the recycling center would be open Friday July 3rd
from 1:00 to 5:00 p.m. Fredrick asked Officer Dave Beal about the dog
issue and the Cemetery issue will be reviewed the next meeting.
Supervisor Todd Wilson is now on speaker phone from Alaska to act on
the liquor licenses. MOTION BY TIETZ AND SECOND BY FREDRICK TO
APPROVE THE CLASS A BEER AND LIQUOR LICENSE FOR RACHEL SMITH,
R-STATION. Vote called by Clerk, Fredrick aye, Wilson aye, Tietz aye.
M. C. MOTION WAS MADE BY FREDRICK AND SECOND BY TIETZ TO APPROVE
THE CLASS B BEER AND LIQUOR LICENSE FOR PHIL EPPLER, AGENT FOR
SPORTHAUSE.

Chairman Fredrick allowed public input before the next license as
before on the other liquor licenses. Carol Vawter spoke reading from
the note she had sent to the hearing and George Feller’s note was also
read. Jane Schmidt and Steve Schmidt spoke in opposition. Attorney
for Roadhouse, Jeff Scott Olson read a letter he sent the Board into
the record. Attorney Doug Plier for the Town of Lebanon also spoke.
MOTION WAS MADE BY FREDRICK AND SECOND BY WILSON TO APPROVE THE CLASS
B BEER AND LIQUOR LICENSE FOR THE ROADHOUSE, GENTELMENS CLUB. Clerk
called the vote Fredrick aye, Wilson after statement that he regrets
that he can not vote his conscience voted aye, and Tietz also stating
he regrets he can not vote his conscience voted aye. M. C.
